2. Interpretation

6. Veterinary Accounts

Creating a Veterinary Account
Veterinarians can join our platform by creating an account specifically designed for veterinary professionals. This account allows them to showcase their services, expertise, and credentials. To create a veterinary account, the following steps must be followed:

  • Registration: Veterinarians must complete the registration form available on our website, providing accurate and complete information about their practice, qualifications, and experience.
  • Verification: After registration, veterinarians must undergo a verification process to ensure the legitimacy of their credentials. This includes submitting copies of their professional licenses, certifications, and any other relevant documentation.
  • Approval: Once the submitted documents are reviewed and verified by our team, the veterinary account will be approved, and the veterinarian will receive a confirmation email.
Displaying Information
Upon successful verification, veterinarians can display the following details on their profile:
  • Professional Information: Including qualifications, specializations, years of experience, and affiliations with professional bodies.
  • Contact Information: Such as clinic address, phone number, email, and website.
  • Services Offered: A detailed list of veterinary services provided, including consultations, treatments, surgeries, and any special services.
  • Media Uploads: Veterinarians can upload images and videos related to their practice, showcasing their facilities, equipment, and patient care.
Usage of the Platform
It is important to note that Titans Pet does not provide veterinary services directly. We offer a platform for verified veterinarians to present their services and connect with potential clients. The following terms apply:
  • Professional Conduct: Veterinarians must adhere to professional conduct guidelines and ensure all information provided is accurate and up-to-date.
  • Client Interactions: Any interactions between veterinarians and clients through the platform must be conducted professionally and ethically.
  • Independent Services: All veterinary services are provided independently by the veterinarians. Titans Pet is not responsible for the quality, outcomes, or any issues arising from the veterinary services offered through the platform.
Limitations and Liability
  • No Endorsement: The inclusion of a veterinarian on the Titans Pet platform does not imply endorsement or recommendation by Titans Pet.
  • No Liability: Titans Pet is not liable for any damages, claims, or disputes arising from the veterinary services provided by the veterinarians listed on our platform.
  • Dispute Resolution: Any disputes or issues related to the veterinary services must be resolved directly between the veterinarian and the client. Titans Pet is not responsible for mediating or resolving such disputes.
By creating a veterinary account on Titans Pet, you agree to these terms and conditions and commit to maintaining the highest standards of veterinary practice.

7. Event Sections

Advertising Events

  • Registration: Event promoters and users must create an account and provide accurate information to list their events on the Titans Pet UK platform.
  • Verification: All events must undergo a verification process to ensure they meet the platform's standards. Promoters and users must provide:
    • Detailed information about the event, including date, time, location, and type of event.
    • Necessary permissions and approvals for hosting the event.
    • Any relevant documentation or certifications, such as insurance certificates, health and safety compliance, and animal welfare documentation.
Content and Media
  • Images and Videos: Users can upload images and videos to advertise their events. All media must be clear and relevant and adhere to the platform's content guidelines. The media should provide a true representation of the event and its facilities.
  • Accuracy: All information provided about the event must be accurate and up-to-date. Misleading or false information will result in the removal of the event listing and potential suspension of the user's account.
Usage of the Platform
  • Hosting Disclaimer: Titans Pet UK is not directly or indirectly involved in hosting any pet events. We only provide a platform for users to advertise their events. Titans Pet UK does not assume any responsibility for the organization or management of the events.
  • Approval and Publication: Events will only be published on the platform after verification and approval by Titans Pet UK. This process ensures that all necessary information and documentation have been provided and meets our standards. Users are responsible for ensuring their event complies with all applicable laws and regulations.
User Responsibilities
  • Promoter Responsibilities:
    • Ensure all necessary permissions and approvals are obtained for the event, including licenses from local authorities if required.
    • Provide accurate and truthful information about the event, including any changes or updates.
    • Respond to inquiries from interested parties promptly and professionally.
    • Adhere to all relevant health and safety regulations, ensuring the safety of all participants and animals.
    • Ensure the event complies with the Animal Welfare Act 2006 and any other relevant animal welfare legislation.
  • User Responsibilities:
    • Verify the information provided by the event promoter, including the legitimacy and safety of the event.
    • Ensure participation in events is conducted safely and legally, following all event guidelines and regulations.
    • Report any suspicious or fraudulent activities related to event listings to Titans Pet UK for further investigation.
Compliance with UK Law
  • Legal Compliance: All events must comply with UK laws and regulations, including health and safety regulations, animal welfare laws, and any specific local council requirements. Promoters must stay informed about and adhere to any changes in legislation that may affect their event.
  • Licensing: Promoters must ensure they have obtained all necessary licenses and permits required to host their event. This may include but is not limited to, public entertainment licenses, animal exhibition licenses, and food safety certifications if food and beverages are served.
  • Insurance: Promoters must have appropriate insurance coverage for their events, including public liability insurance, to cover any potential accidents or injuries that may occur during the event. Proof of insurance must be provided during the verification process.
Limitations and Liability
  • No Endorsement: The listing of an event on Titans Pet UK does not imply endorsement or recommendation by Titans Pet UK. Users should independently verify the legitimacy and quality of the events listed.
  • No Liability: Titans Pet UK is not liable for any damages, claims, or disputes arising from the promotion or participation in events advertised on our platform. This includes but is not limited to, personal injury, property damage, or financial loss.
  • Dispute Resolution: Any disputes or issues related to the events must be resolved directly between the promoter and the participants. Titans Pet UK is not responsible for mediating or resolving such disputes but may assist in facilitating communication between parties if necessary.
  • Compliance: Users must comply with all UK laws and regulations related to hosting and attending pet events. Non-compliance may result in the removal of event listings and suspension of user accounts.
By using the Event Section feature on Titans Pet UK, you agree to these specific terms and conditions and commit to ensuring all advertised events meet the required standards.

7(a). Content

Your Right to Post Content
Our Service allows you to post Content. You are responsible for the Content that you post to the Service, including its legality, reliability, and appropriateness.
By posting Content to the Service, you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Service. You retain any and all of your rights to any Content you submit, post, or display on or through the Service, and you are responsible for protecting those rights. You agree that this license includes the right for us to make your Content available to other users of the Service, who may also use your Content subject to these Terms.
You represent and warrant that: (i) the Content is yours (you own it), or you have the right to use it and grant us the rights and license as provided in these Terms, and (ii) the posting of your Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person.

The Company is not responsible for the Content of the Service's users. You expressly understand and agree that you are solely responsible for the Content and for all activity that occurs under your account, whether done so by you or any third person using your account.
You may not transmit any Content that is unlawful, offensive, upsetting, intended to disgust, threatening, libelous, defamatory, obscene, or otherwise objectionable. Examples of such objectionable Content include, but are not limited to, the following:

  • Defamatory, discriminatory, or mean-spirited Content, including references or commentary about religion, race, sexual orientation, gender, national/ethnic origin, or other targeted groups.
  • Spam, machine or randomly generated, constituting unauthorized or unsolicited advertising, chain letters, any other form of unauthorized solicitation, or any form of lottery or gambling.
  • Containing or installing any viruses, worms, malware, trojan horses, or other Content that is designed or intended to disrupt, damage, or limit the functioning of any software, hardware, or telecommunications equipment or to damage or obtain unauthorized access to any data or other information of a third person.

The Company reserves the right, but not the obligation, to, in its sole discretion, determine whether or not any Content is appropriate and complies with these Terms, refuse or remove this Content. The Company further reserves the right to make formatting and edits and change the manner of any Content. The Company can also limit or revoke the use of the Service if you post such objectionable Content. As the Company cannot control all Content posted by users and/or third parties on the Service, you agree to use the Service at your own risk. You understand that by using the Service, you may be exposed to Content that you may find offensive, indecent, incorrect, or objectionable, and you agree that under no circumstances will the Company be liable in any way for any content, including any errors or omissions in any content, or any loss or damage of any kind incurred as a result of your use of any content.

Content Backups
Although regular backups of Content are performed, the Company does not guarantee there will be no loss or corruption of data.
Corrupt or invalid backup points may be caused by, without limitation, Content that is corrupted prior to being backed up or that changes during the time a backup is performed.
The Company will provide support and attempt to troubleshoot any known or discovered issues that may affect the backups of Content. But you acknowledge that the Company has no liability related to the integrity of Content or the failure to successfully restore Content to a usable state.
You agree to maintain a complete and accurate copy of any Content in a location independent of the Service.

11. Termination

By Us
We reserve the right to cancel any advert or account:

  • With immediate effect and without notice if you breach any of these terms.
  • For any reason, at our discretion, with notice given via email.
By You
You agree that you have no right to cancel this agreement under the Consumer Contracts (Information, Cancellation, and Additional Charges) Regulations 2013.

12. Limitation of Liability

In no event shall the Company, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service;
  • Any conduct or Content of any third party on the Service;
  • Any content obtained from the Service;
  • Unauthorized access, use, or alteration of your transmissions or Content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

21. General Ad Posting Rules

When posting any advert on Titans Pet, you agree to the following conditions:

  • Any pet advertised must be owned by you unless specified that they are being sold on behalf of a charity organization.
  • Pets must meet age and health guidelines for rehoming.
  • All ads must be honest and accurate, with the pet's full breed disclosed.
  • Crossbreed pets must be explicitly mentioned in your description and advertised in the mixed breed category.
  • All uploaded photos must be of the actual pet you wish to rehome.
  • Adverts must not promote pets as gifts or presents.
  • Pets advertised must be located in the UK, and the location stated on your listing must be the actual location where the animal is permanently housed.
  • We do not allow pets imported into the UK for the purpose of sale to be advertised.
  • Pregnant pets or pets suspected of being pregnant must not be advertised.
  • Swapping or exchanging pets is not permitted.
  • You must disclose all health and welfare issues associated with any pet you wish to rehome.
  • Pets must be available for viewing at your home or place of business.

22. Dog/Cat Specific Ad Posting Rules

In addition to the general ad posting rules, the following apply specifically to dogs and cats:

  • Dogs must be microchipped from the age of 8 weeks and older, and cats in England from the age of 20 weeks and older.
  • Only dogs and cats that are family pets may be advertised; guard dogs or those trained for protection or hunting are not allowed.
  • Dogs with cropped ears or bred in aesthetic pets are not permitted.
  • Pets for breeding purposes must not be advertised.
  • Co-ownership, rent, or loan agreements for dogs or cats listed outside of the stud category are not allowed.
  • Double-dapple or double-merle dogs are not permitted.

23. Other Animals Ad Posting Rules

When posting adverts for animals other than dogs or cats, the following conditions apply:

  • Live vertebrates must not be advertised as food.
  • For animals listed under Annex A of the CITES regulations, a valid Article 10 certificate must be stated in the advert.
  • Adverts for primates, wild-caught animals, or those under the Dangerous Wild Animals Act are not allowed.
  • Horses must be microchipped and have a passport.

24. Breeding and Licenses

  • Breeders must provide a copy of their breeding license if required by local council regulations.
  • Pet shop license holders can only advertise pets they have bred themselves in the UK.
  • If two different litters are posted or born within a 30-day period, a breeding license must be provided.

25. Accounts

To fully benefit from our site, you must create an account. When creating an account, you agree to:

  • Provide complete, accurate, and truthful information.
  • Keep your account information up to date.
  • Clearly state whether you are using the services as a private individual, breeder, rescue center, or company.
  • Enter your correct full address before placing an advert.
  • Use only one account to advertise any pets you own or breed.
  • Do not reuse old listings to advertise new pets or litters.
  • Resolve any complaints regarding your account to the satisfaction of both the customer and us.
  • Do not share your account or advertise pets on behalf of others.
  • Keep your account details secure and confidential.

26. Contacting Advertisers

  • Verify the accuracy of any information provided by advertisers.
  • Do not send money online unless you are using our secure payment system.
  • Always visit the pet at the advertiser's home before making any payment.

27. Payments and Fees

  • Payments for services are processed through Stripe.
  • You are responsible for paying any applicable fees.
  • Payments are non-refundable if your account is terminated due to a breach of these terms.

28. Cancellation By Us

We have the absolute right to cancel any Advert which you place on the Site and/or to cancel your Account:

  • With immediate effect and without notice if we know or suspect that you have broken any of these terms and conditions and
  • With immediate effect, if we give you notice to that effect by email to you for any reason, we, in our absolute discretion, think fit.
You agree that you are not entitled to any compensation should we choose to cancel an advertisement or your Account, whether with or without reason.

29. Cancellation By You

You agree that, for the purposes of the Consumer Contracts (Information, Cancellation, and Additional Charges) Regulations 2013, no "sale" is involved in the services we provide and that you have no right to cancel this Agreement.

30. Availability of the Site

We never guarantee that the Site or the System will be available all the time, and if it's not available for any reason, you can't hold us responsible for anything you lose as a result.
We have the right to change the Site and the services it offers, the way it operates, and/or suspend it or stop it at any time.

31. Limitation of Liability

We have limited resources and cannot guarantee that we will respond to any message you send to us, within a specific timeframe or at all. Whilst we will always do our best to respond to you within 24 hours, we will have no liability if we are unable to do so.
Please bear in mind that we are a platform for the display of pets for rehoming, accessories, and services and have no facilities for and neither do we offer any vetting service to the advertisers. We have no control over any transaction in which you are involved, and neither can we verify the truth of any statements made in an Advert. Before you agree to re-home or to supply any animal, you agree to take all the precautions needed to make sure that the person with whom you are dealing has been open and honest.
You enter into any transaction with any other user of this Site at your own risk.
We do not accept any liability if you are using the services we supply for commercial purposes.
On behalf of us and anyone who works with or for us (as far as we are allowed by law) we deny liability for any losses of all kinds which you incur from using the services we offer, visiting the Site and using the System.
We will have no liability on the ending of any advertisement you have placed on the Site, if either you or we terminate your Account.
If we are found to be liable for any loss you sustain, you accept and agree that our liability is limited to the direct losses you have sustained and will not include any loss to your goodwill, profit, or reputation or any indirect, special, or consequential losses of any nature and you agree that the maximum amount you may recover in respect of any direct losses is limited to £100.00. Nothing in these T&Cs excludes or restricts our liability for death or personal injury resulting from any negligence or fraud on our part.

32. Links to Other Websites

We don't control any of the websites we link to and so we can't be responsible for the Content of such websites and disclaim liability for any losses which come out of you using them.
Just because we link to a site does not mean that we endorse or recommend that site.
We can never guarantee that a link will work.
If you find any link we offer to be offensive, please let us know and we will consider removing it.
If you link to any other site using our Site then you understand that separate conditions will apply to those sites and that we have no control over those conditions – so you agree that you will read and understand them before using those sites.

33. Modifications of These Terms and Conditions & the Site

We've already said this, but we need to make it clear that these T&Cs will change from time to time. As a result, you MUST come back to this page to make sure that we haven't changed the T&Cs, and whenever you access the Site, you are confirming to us that you are aware of any changes.
We've also got the right to change the Site as and when we want to, but these T&Cs will still apply to any changes we make.

34. General

This agreement is governed by the laws of England and Wales.
This agreement does not create any partnership or joint venture.
If any part of this agreement is unenforceable, the rest will remain in effect.
